Official Policy Notice

These Terms and Conditions govern enquiries, bookings and purchases made with Scarlz Moments Private Limited under the WAIG brand, whether through https://waig.in or an Authorised Booking Channel. They apply to Mystery Tours, Plan My Tour services, other confirmed travel services and Gift Vouchers, and form a binding agreement between WAIG and the person who submits an enquiry or makes a booking or purchase. The commercial terms shown at checkout and in the booking confirmation, itinerary, invoice or voucher issued for a transaction form part of these Terms. If a specific confirmed term conflicts with these general Terms, the specific confirmed term will prevail for that transaction, except to the extent prohibited by law.

This document sets forth the principles and rules governing your engagement with WAIG. As our service offerings expand, comprehensive clauses will be updated directly on this page.

01.

About WAIG

WAIG is a brand operated by Scarlz Moments Private Limited, having its registered office at Door No 14/102, 116/1, Sir Theagaraya Road, T.Nagar, Chennai - 600017, India. WAIG designs and coordinates travel packages using services supplied by independent Service Providers. WAIG is responsible for its own representations, booking administration and coordination obligations. Each Service Provider remains responsible for the service it independently operates, subject to applicable law.

WAIG offers Mystery Tours and customer-specified destination tours within India and internationally. International Mystery Tours are ordinarily offered for destinations that, at the relevant time, are presented as visa-free or visa-on-arrival destinations for eligible Indian citizens. Entry requirements can change without notice and remain subject to the decision of the relevant government and border authorities.

03.

Eligibility and authority

A person making a Booking or purchasing a Gift Voucher must be at least eighteen years old and legally capable of entering into a contract. The Booking Lead confirms that she or he is authorised to provide instructions and personal information for every Traveller and to accept these Terms on their behalf where legally permitted.

Where a Traveller is under eighteen, the Booking Lead must be the parent or lawful guardian or must have that person's authority. WAIG may request evidence of age, authority or parental or guardian consent before processing a Booking.

04.

Booking channels use and acceptance

The Website and each Authorised Booking Channel may be used only for lawful personal enquiries, bookings and purchases. A Booking Lead must receive or be given access to these Terms, the Privacy Policy and the Cancellation Modification and Refund Policy before payment and must expressly accept them.

For a Website transaction, acceptance must be given by a clear affirmative action, such as selecting an unticked checkbox before proceeding to payment. For an offline enquiry or Booking request received by email, telephone, WhatsApp or social media, or through an authorised employee, call centre, agent or service provider, WAIG must send the applicable documents or links by email, WhatsApp or another durable electronic channel and obtain written or otherwise verifiable express acceptance before confirming the Booking. A telephone conversation or enquiry alone does not constitute acceptance.

WAIG may retain an electronic record of acceptance, including the user or Booking Lead, date and time, IP or system log, document title and version, acceptance wording, booking reference and payment status. Accessing general pages alone does not create a Booking.

A user must not:

  • submit false, incomplete, misleading or unauthorised information;
  • attempt to gain unauthorised access to any account, booking or system;
  • interfere with the Website, introduce malicious code, scrape it at scale or circumvent security controls;
  • use the Website for fraud, resale without authority, unlawful activity or infringement of another person's rights; or
  • copy, reproduce or commercially exploit Website content except as permitted by law or with WAIG's written consent.
05.

Mystery Tour model

A Mystery Tour is intentionally sold without disclosing the destination at the time of booking. The customer selects or states relevant parameters through the questionnaire, which may include departure city, domestic or international travel, dates, duration, number and age category of Travellers, travel mode, broad preferences or vibe, package and budget.

WAIG will use the submitted information to curate a destination and itinerary within the confirmed package. Preferences are requests, not guarantees, unless WAIG expressly records them as confirmed requirements in writing. A customer must clearly identify any non-negotiable medical, accessibility, safety, dietary or travel-document restriction before payment. WAIG may decline a Booking that it cannot reasonably accommodate.

WAIG ordinarily sends the destination reveal and travel information to the contact details registered for the Booking 24 to 48 hours before departure. The Booking Lead must remain reachable and must promptly review the reveal. Where a trip requires items beyond those ordinarily needed for travel, WAIG will endeavour to provide general, non-destination-specific packing guidance at least 7 days before departure and any destination-specific guidance with the reveal.

Dislike of, or a preference for an alternative to, a destination or itinerary selected consistently with the confirmed Booking parameters does not amount to a deficiency in service and will be treated as a customer-requested cancellation or amendment. This does not affect remedies for a material departure from an expressly confirmed requirement or any non-excludable consumer right.

06.

Plan My Tour

Plan My Tour begins as an enquiry and does not constitute a confirmed Booking. It covers both Mystery Tours and customer-specified destination tours. It is also the enquiry route for a group of more than 8 Travellers or a trip exceeding 6 nights. WAIG may discuss the requested or preferred destination, itinerary, budget, dates and Traveller requirements and will issue a proposal or confirmation setting out the services and price. A Booking is created only in accordance with Section 10.

07.

Package inclusions and exclusions

Only the items expressly listed as included in the applicable proposal or Booking confirmation are part of the package. Air or other transport, accommodation, meals, activities, transfers, insurance, taxes, permits and other components are included only if expressly stated. Personal expenses, optional activities, documentation charges, medical costs and items not listed as included are excluded.

Images, descriptions, maps and examples on the Website are illustrative unless tied to a specific confirmed Booking. Hotel categories and standards vary between destinations and countries. WAIG may substitute a Service Provider or component with a reasonably comparable alternative where necessary, subject to Section 16 and applicable law.

08.

Travel modes and dates

Available travel modes may include flight, private road travel or an open-to-options selection. WAIG's current international packages use flights as the principal mode of travel. If the customer selects open to options, WAIG may choose flight or private road travel having regard to the package, route, availability, safety and conditions. WAIG will obtain the customer's agreement before using bus or train as the principal mode of travel where that mode was not selected at booking.

For a flight, each Traveller must report at the airport by the time stated by the airline, airport or Booking information. For an international flight, the customer should ordinarily arrive at least 3 hours before departure unless the applicable instruction requires an earlier time. Transport to the departure airport is excluded unless the Booking confirmation expressly includes it.

The current minimum booking lead times are 14 days before departure for domestic trips and 30 days for international trips. Availability and supplier requirements may require a longer period. WAIG may change prospective lead times on the Website, but a change will not retrospectively alter a confirmed Booking.

09.

Traveller information and special requirements

The Booking Lead must provide complete and accurate names, dates of birth, contact details, identity and travel-document information and any other information reasonably required for the Booking. Names must match the relevant identity or travel documents. The Booking Lead must verify all details before WAIG commits a booking with a Service Provider.

Any cost, denial of boarding, cancellation, delay or loss caused by inaccurate, incomplete, late or unauthorised information supplied by the customer will be borne by the customer, except to the extent caused by WAIG's failure to use correctly supplied information.

A Traveller must disclose material mobility, accessibility, medical or other requirements that WAIG or a Service Provider must consider. WAIG will use such information only as described in the Privacy Policy and may request confirmation that a proposed arrangement is suitable. WAIG does not provide medical advice.

10.

Booking and confirmation

Availability shown on the Website, an offline or online enquiry response, a quotation or an initiated payment is not a confirmed Booking. A Booking becomes binding only when WAIG has received and verified the required payment, Traveller information and acceptance of the applicable terms, and has issued a booking confirmation or Booking number through an Authorised Booking Channel.

Before payment, WAIG will display or provide the material package description, total payable amount and mandatory charges, payment schedule, principal cancellation terms and other transaction-specific conditions. The customer must promptly notify WAIG of any error in the confirmation.

WAIG may reject or cancel an unconfirmed request where the selected service is unavailable, information or payment cannot be verified, a pricing error is identified, or the request presents a legal, safety, fraud or operational concern. Any amount captured for a request not accepted by WAIG will be refunded, subject only to lawful deductions that were disclosed and actually incurred.

11.

Prices taxes and pricing errors

The price displayed at checkout or in a proposal applies to the described package at that time. Prices may vary with dates, departure city, duration, Traveller count, travel mode, availability and other selected parameters. WAIG does not presently rely on live airline or hotel application programming interfaces for all package prices, and a displayed price may be maintained or calculated within WAIG's own systems.

Applicable GST, tax collected at source and other statutory charges will be shown or dealt with in the invoice and checkout as required by law. WAIG may correct a genuine typographical, computational or system pricing error before confirmation. If a material error is discovered after confirmation, WAIG will offer the customer the corrected price, a reasonably comparable alternative or cancellation with a full refund of the affected amount; it will not impose a cancellation charge for rejecting the correction.

12.

Payment

Payments may be processed through Razorpay or another disclosed payment service provider. The provider's terms and privacy practices also apply within its payment environment. WAIG ordinarily receives transaction status and reference data and does not intend to store complete card, banking or authentication credentials processed by the payment provider.

Where offered, the customer may pay the full package price or an advance equal to 70% of the package price. Unless the Booking confirmation states otherwise, the balance is due no later than 7 days before a domestic departure and 14 days before an international departure. Failure to pay when due may result in cancellation under the Cancellation Modification and Refund Policy.

A payment is complete only after successful authorisation, capture and verification. Failed, reversed, disputed or charged-back payments may be treated as unpaid. The customer must not initiate an unsupported chargeback and must first give WAIG a reasonable opportunity to address a genuine billing issue.

13.

Gift Vouchers

WAIG may issue Gift Vouchers in denominations of INR 5,000, INR 10,000, INR 15,000 and INR 20,000, or in other values displayed on the Website. A Gift Voucher is valid for 180 days from purchase and may be redeemed only through waig.in against an eligible WAIG Booking before expiry.

The voucher code is sent to the purchaser by email, ordinarily as a PDF. The purchaser may share the code with the intended recipient. WAIG may treat a person who presents a valid unused code as authorised to use it. The purchaser and recipient must keep the code secure, and WAIG is not responsible for unauthorised use resulting from their disclosure or failure to safeguard it, except where the unauthorised use was caused by WAIG.

A Gift Voucher cannot be redeemed for cash and is non-refundable. It will not be extended, reissued or replaced if it is lost, disclosed, not redeemed or remains unused when its 180-day validity expires. These restrictions do not exclude a remedy that applicable law requires or a remedy arising where WAIG cancels or invalidates the voucher without customer fault. Voucher validity, status, expiry and the value applied will be verified at checkout.

Before purchase and redemption, the Website must disclose any minimum Booking value, partial-redemption rule, restriction or treatment of an unused balance that applies to that voucher.

The amount paid to purchase a voucher represents its face value. The voucher amount will be deducted from the package amount, and the customer must pay the remaining amount and applicable taxes or charges shown at checkout.

14.

Amendments requested by the customer

A request to change a date, Traveller, travel mode, package, destination parameter or other confirmed detail is subject to availability and Service Provider rules. WAIG is not obliged to accept an amendment that cannot reasonably be implemented.

If WAIG accepts an amendment, the customer must pay the difference in fare or rate, Service Provider charges and a WAIG amendment fee of INR 5,000 or 5% of the package price, whichever is higher. WAIG will disclose the amount before implementing the amendment. This fee does not apply to a correction of an error caused by WAIG or a change initiated by WAIG.

15.

Cancellation and refunds

All cancellations, no-shows, refunds, duplicate payments and customer or WAIG initiated changes are governed by the Cancellation Modification and Refund Policy available at https://waig.in/cancellation-policy. That policy forms part of these Terms.

Nothing in these Terms or that policy excludes a refund, compensation or other remedy that cannot lawfully be excluded, including a remedy for deficiency in service, an unfair trade practice or a material failure by WAIG to provide a confirmed service.

16.

Itinerary and service changes

Travel arrangements depend on schedules, availability, weather, safety, government action and Service Provider operations. WAIG may make a reasonable change to an itinerary or substitute a comparable component when necessary. WAIG will notify the Booking Lead as soon as reasonably practicable of a material change and explain the available alternative, credit or refund position.

If WAIG makes a material change within its reasonable control and the customer does not accept a reasonable alternative, the customer may cancel the materially affected service without a WAIG cancellation charge and receive a refund for that service. Changes outside WAIG's reasonable control are handled under Section 22 and the Cancellation Modification and Refund Policy.

17.

Service Providers

Flights, hotels, transport, insurance, activities and other components may be performed by independent Service Providers whose applicable carriage, check-in, conduct, safety and cancellation conditions bind the Traveller once properly disclosed or incorporated. WAIG will exercise reasonable care in selecting and coordinating Service Providers but does not operate or control their independent services.

WAIG does not exclude responsibility for its own negligence, misrepresentation, booking error or breach. A customer's rights against a Service Provider and any mandatory right against WAIG are preserved. WAIG may assist the customer in seeking a supplier remedy but cannot promise an outcome controlled by an independent supplier.

18.

Passports visas and entry requirements

Each Traveller is responsible for obtaining and carrying a valid passport, visa, permit, identity document, insurance evidence, vaccination or health certificate and any other document required by an authority or Service Provider. Passport validity and blank-page requirements vary by destination and must be checked against current official requirements.

Any statement by WAIG that a destination is visa-free or offers visa on arrival is general guidance based on information available at the relevant time and is not a guarantee of admission. Entry remains at the discretion of the authorities. WAIG is responsible only where it expressly undertakes a visa service and fails to perform that service with reasonable care.

19.

Travel insurance

Insurance is included only where the Booking confirmation says so. Any policy is issued by the insurer and is subject to its wording, exclusions, limits and claims process. WAIG does not decide claims or guarantee cover. Travellers should consider insurance appropriate to cancellation, delay, baggage, medical treatment, evacuation and their personal circumstances.

20.

Traveller conduct

Each Traveller must comply with law and reasonable instructions of authorities, WAIG and Service Providers; respect property and other persons; arrive on time; and avoid conduct that threatens safety or disrupts a service. WAIG or a Service Provider may refuse or discontinue a service where reasonably necessary for safety, legality or serious misconduct. The customer will bear resulting costs where the action arises from that Traveller's conduct, subject to applicable law.

21.

Health safety and travel advisories

Travellers must assess the suitability of travel for their circumstances and obtain professional medical advice where appropriate. Conditions and official travel advisories may change. WAIG may alter or cancel an arrangement where reasonably necessary to protect safety or comply with an official direction, without limiting the customer's rights under the Cancellation Modification and Refund Policy.

22.

Events beyond reasonable control

WAIG is not liable for a failure or delay caused by an event beyond its reasonable control, including severe weather, natural disaster, epidemic, war, civil unrest, strike, airport or route closure, transport disruption, government restriction, change in entry rules or a comparable event, provided WAIG takes reasonable steps to mitigate the effect and informs the customer when practicable. Where such an event affects a Booking, WAIG may offer a reasonable alternative, rescheduling, credit or a refund calculated under the Cancellation Modification and Refund Policy, having regard to amounts recoverable from Service Providers and costs already and irreversibly incurred. This clause does not excuse payment or performance that was already due before the event or remove non-excludable statutory rights.

23.

Communications

WAIG may use email, SMS, telephone, WhatsApp, live chat or another disclosed channel for enquiries, payment messages, confirmations, invoices, voucher delivery, destination reveal, itinerary changes, support and other service communications. The Booking Lead must provide accessible contact details and monitor them until completion of travel. Marketing messages will be sent only in accordance with applicable law and available communication preferences. Consent to service communications is not consent to marketing.

24.

Privacy and children

WAIG handles personal information in accordance with its Privacy Policy at https://waig.in/privacy-policy. The Booking Lead must read that policy before supplying information about another Traveller and must obtain any consent or authority required to provide information about a child.

25.

Customer content and publicity

A customer who sends a review, photograph or video grants WAIG a limited, non-exclusive licence to receive, store and use it for the purpose for which it was submitted. WAIG will use identifiable customer content for advertising, testimonials or public social-media publication only under a separate clear permission or where the customer has unmistakably submitted it for that public purpose. A customer may withdraw permission for future use by writing to WAIG, subject to uses already lawfully completed.

26.

Intellectual property

The Website, WAIG name and logo, text, graphics, photographs, design, interface, software and other content are owned by or licensed to WAIG and protected by applicable law. WAIG grants users a limited, revocable, non-transferable right to access the Website for personal use. No other licence is granted.

27.

Website and third party links

WAIG endeavours to keep the Website accurate and available but does not guarantee uninterrupted or error-free access. It may suspend access for maintenance, security or operational reasons. Third-party links and payment or communication interfaces are provided for convenience and are governed by their operators' terms. WAIG is not responsible for content or processing that it does not control.

28.

Limitation of liability

To the fullest extent permitted by law, WAIG is not liable for indirect or consequential loss that was not reasonably foreseeable when the Booking was made, or for loss caused solely by the independent act of a Service Provider or an event beyond WAIG's reasonable control where WAIG exercised reasonable care.

For a claim arising from a particular Booking, WAIG's aggregate contractual liability will not exceed the amount paid to WAIG for the affected Booking. This cap does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by WAIG where liability cannot be limited, breach of confidentiality or privacy obligations to the extent a limit is prohibited, or any consumer or statutory remedy that cannot lawfully be excluded or restricted.

29.

Customer indemnity

To the extent permitted by law, the Booking Lead will indemnify WAIG against a third-party claim or direct loss arising from a deliberate or negligent material breach of these Terms, unauthorised or false information supplied for a Traveller, unlawful Website use, infringement of third-party rights or serious Traveller misconduct. The indemnity does not cover loss caused by WAIG and is subject to WAIG taking reasonable steps to mitigate its loss.

30.

Suspension and cancellation for cause

WAIG may suspend Website access or cancel an affected transaction where it reasonably suspects fraud, unlawful conduct, non-payment, a material information defect, abuse or a serious security or safety risk. WAIG will act proportionately, give notice where practicable and handle amounts paid in accordance with the reason for cancellation, applicable supplier commitments and law.

31.

Complaints

A customer should report a booking problem promptly so that WAIG has a reasonable opportunity to investigate and assist. The complaint should include the Booking number, Traveller name, contact details, a clear description and supporting material. Delay does not extinguish a statutory right, but it may limit WAIG's ability to resolve an issue while travel is ongoing.

32.

Governing law and disputes

These Terms are governed by Indian law. The parties will first attempt in good faith to resolve a dispute through WAIG's grievance process. Subject to any mandatory right of a consumer to approach a competent Consumer Commission or other statutory forum, the courts and tribunals having jurisdiction at Chennai, Tamil Nadu will have jurisdiction.

33.

Changes to these Terms

WAIG may update these Terms for future use of the Website and future transactions by publishing a revised version and effective date. A material change will not retrospectively reduce rights under a confirmed Booking unless required by law or reasonably necessary for safety, and then only to the extent permitted by law. WAIG will seek fresh acceptance where applicable law or the nature of the change requires it.

34.

General provisions

If a provision is invalid or unenforceable, it will be read down to the minimum extent necessary and the remaining provisions will continue. WAIG's failure to enforce a provision on one occasion is not a waiver. The customer may not transfer a Booking except with WAIG's written agreement and subject to Service Provider rules. Headings assist navigation and do not limit the text.

35.
